HOW TO COMPLAIN ABOUT REAL ESTATE SIGNS

A member of the Avery/Watauga Assoc of Realtors sent this information:

Declaration of Restrictions recorded against every residential lot developed by Carolina Caribbean Corporation require the following:

Paragraph 10: No commercial signs, including "for rent", "for sale", and other similar signs, shall be erected or maintained on any lot except with the written permission of the Company or except as may be, requires by legal proceedings, it being understood that the Company will not grant permission for said sign unless their erection is reasonably necessary to avert serious hardship to the property owner. Property identification and like signs exceeding a combined total of more than three (3) square feet may not be erected without the written permission of the Company.

Below paragraph 19, the restrictions go on to say:

In the event of a violation or breach of any of these restrictions by any property owner, or agent, or agent of such owner, the owners of lots in the neighborhood or subdivision, or any of them jointly or severally, shall have the right to proceed at law or in equity to compel a compliance to the terms hereof or to prevent the violation or breach in any event. In addition to the foregoing, the Company shall have the right, whenever there shall have been built on any lot in the subdivision any structure which is in violation if these restrictions, to enter upon the property where such violation exists, and summarily abate or remove the same at the expense of the owner, if after thirty (30) days within the abatement or removal shall not be deemed a trespass. The failure to enforce any right, reservation, restriction, or condition contained in this Declaration of Restrictions, however long continued shall not be deemed a waiver of the rights to do so hereafter; as to the dame breach or as to a breach occurring prior or subsequent thereto and shall not bar or affect its enforcement. The invalidation by any court of any restrictions in this Declaration of Restrictions contained shall in no way affect any of the other restrictions, but they shall remain in full force and effect.

Obviously any property owner can file a suit against any sign violation. But as a "REALTOR" I am compelled by our code of ethics to recommend an easier way to deal with the problem. Most agents in our community are members of the Avery/Watauga Association of Realtors and subscribe to their Code of Ethics. A member of the public can file a grievance against a Realtor for violating our restrictive covenants.

Barbara More is sharing her secret!

The secret is beating the Deer at their own game.....eating your plants and flowers. It's very simple. No soap, smelly fluids, etc. Just beautiful garden ornaments that she has purchased at craft shows and friends have given her.

Her story is that she has never had anything eaten in her garden, with exception of one year, when they arrived later than normal, and her ornaments were not there. The Deer did eat her garden, like everyone else on St. Andrews...but as soon as she put them back, no more trouble!

She thinks it's the silver tones and movements of the ornaments. She adds that these do not protect gardens from hail! Thanks, Barbara. I for one, am going to try this next year. The Deer have already eaten all my flowers, this year.

GOLF PRACTICE FACILITY IS NOW OPEN!

Here are some pictures, that were taken late Wednesday afternoon. Golfers are beginning to gather, and enjoy it. It is open to all BMC members and their guests. At this time, you must pick up your balls at the PRO shop, and they are free!

The range will be open from 7 til 5:45. You can use your private cart, or a Golf Course Cart to drive down from the Pro Shop. Paul, from the Pro Shop, wants you to know that it is two way traffic down to the tees, so keep that in mind. Call the Pro Shop for details 387-2372. Lessons can also be purchased.
Rory Ellington, Golf Course Supt, is in the upper middle picture. He is the one who has created this outstanding practice facility.

BMLGA HAD PLAY, LUNCHEON, AND ELECTION OF OFFICERS

Our game was ABCD 1-2-3-Cha Cha Cha. Teams were evenly matched, and the game was net, using either one, two, or three best balls on certain holes. It was lots of fun.

We had a delicious lunch at the club, and afterwards, the following officers were elected for next year. Joan Wichman, President, Becky Welch, Vice-President, Jane Sorrick, Secretary, Vivian Lager, Treasurer, and Sondra Rice, Member at Large.

The pictures are of John Carrin, reviewing a players score, Joan Wichman, leading the meeting, and some of our members. We will be meeting til Oct 9th. Our Fall Guest Day is scheduled for Sept 11, and we are playing Interclub at Elk River and Linville Country Club. Beech Mountain Club members with yearly beginning Handicap Index of 37.1 are welcome to join.

Two Thoughts from Nancy

1) HOW DO YOU LIKE THE LOUD DUMP TRUCK NOISE?

I live on Pine Ridge Rd., and on most days, there are many, many loud dump trucks going by our home. One of my friends who lives closer to Beech Mtn Parkway, said that she and her husband cannot talk, while they are passing their home.

My idea: I think many of these trucks come up the mountain from Banner Elk, driving completely through the town, and are actually delivering their loads, outside the town, meanwhile causing noise and damage to our roads. Many towns restrict heavy trucks. How about the Town Council passing a law, that any truck making a delivery within the town of Beech Mountain, can use the Beech Mtn Parkway, but all other trucks must use the back road from Boone?

2) HAVE YOU LOOKED AT THE BMP BETWEEN THE TOWN LINE AT THE TOP OF THE MOUNTAIN AND THE SKI SLOPES?

The road is in terrible condition. Every year, the state does not stripe it til the end of August. Meanwhile our family and guests have to search for the road in rainy and foggy conditions.

My Idea: Have the town meet with the state, and inform them that it is just too dangerous to have an unstriped road with such heavy traffic in our community. This section of the road is only 1.3 miles. Certainly Beech could afford to stripe it themselves or make a deal with the state. Not only is it a safety issue, but the appearance of the road is awful. Every building is in excellent condition, but the road turns Beech Mtn into a shabby appearing community.

What do you think?

Do You Want to See Real Estates Signs all over Beech Mtn? Neither Do I!!!

Three or four weeks ago I had the opportunity to stop by the Town of Beech Mountain and meet with Bobby Dziewulski who works in the Inspections/Zoning Dept. Bobby is a very nice person who never hesitates to take the time to explain the various ordinances that I may have questions on. The ordinances are available for viewing on the Town's website: http://www.townofbeechmountain.com/services/ordinances.html. However, (to continue, click 'comments')

Pictures of the New Golf Practice Facility!

According to Rory Ellington, Golf Course Supt., the new BMC Golf Practice Facility will open on Monday, August 27th. Our tribute to Rory and his staff! I don't know how many rocks and dirt or seeds and sod were involved, but the result is beautiful, and something the BMC members, and their families, and guests, will enjoy for years to come!

WHERE ARE BILL AND ERMA JAMES?

Read this and all the comments.

Hi Everyone,
Well, I was going to wait till Beech Mt., but I've got time now & probably will be busy then so here goes.
We're in a campground called "Prairie Acres" & yes, it is - maybe a tree or two in the distance & very
windy but warm - fields of grain (wheat) as far as you can see.
After Vancouver & the ferry back & forth to Victoria & visiting Peggy Schlapkohl on the west side which
was a beautiful but rough drive across the island, we finally got back in the lower 48 as they say.
We had planned to drive through Glacier Nat. Pk in western Montana but no vehicles over 21' were
allowed through the park because of bad roads (they don't know what we went through in Canada &
Alaska "top of the world highway"). So, we skirted the Park. It was extremely smoggy because of
fires north of Missoula. We could hardly see anything in the Park. The smog thinned a little as we
traveled across Montana on Hwy. 2 but didn't really clear yet. We're not sure if it's dust from the prairie
or from the fires. It's very dry everywhere.
We've decided to make a little detour north to Canada into Saskatchewan & Manitoba so we can
color in our small map of where we've all been with our RV. This is the first time for N.D. & we also
have to head south to pick up Nebraska. Pebbles is now a prairie dog.
We'll be back in N.C. probably next Sat. 8/27 - Catch you then - Erma & Bill

Garden & Herb Society Annual Herbal Tea

Ann Martin led our group this last year, and we are having a wonderful time. Next year, Suzanne Powell and Candyce Scherer will serve as Co-Chr. Carol Richardt will be Sec-Treas, Nancy Brunzos will be in charge of Programs, and Ann Martin will be in charge of our groups participation in Mimosa Morning.

Our meetings are held on two Monday mornings a month, during the summer. It's a great place to meet other BMC members, and get to know them.

Be Careful on the Beech Mtn Parkway!

I was driving up the Beech Mountain Parkway, after church, and saw that an unmarked white police car had pulled over a driver of a car, heading to Banner Elk. I called the Beech Mtn Police Dept, and was told that they do have an unmarked police car in use.

HAVE YOU SEEN A HURT DEER?

Debbie Canady just called me to advise that there is a hurt deer running around Beech right now. The deer has a broken bone and LeslIe from GENESIS WILDLIFE SANCTUARY is trying to find her so she can dart her and FIX her leg. If you see the deer she might be running in a pack of three please call genesis and advise 387-2979
Dee

Note: This is an approximately two-year old buck in velvet. The right horn is slightly shorter than the left, which is starting to branch into two. The longer is probably about 10" long. It appears his rear left hip has been broken and he tries not to walk or run on that leg. I last saw him this morning at about 8:00 a.m., travelling with 3 other young deer, crossing BM Pkwy. and going toward Destiny Inn. Your help in assisting this young buck would be appreciated if you happen to see him.

Special News about Max Richards

Max's wife, Ruth, told me that they were invited to a reunion of the management faculty, who worked with Max, during his tenure at Penn State. The renunion was to close after a barbecue at the Dean's residence. At one point, the Dean read a statement regarding a contribution of $100,000 that was given to the College of Business Administration in Max D. Richards name by Don Hambrick and his wife Peg. Don was a former student who studied under Max and went on to a number of highly regarded studies about top management. Don gave Max a number of accolades, as did other faculty present. Max was SURPRISED and proud.

And we are certainly proud of Max, who is shown, in the picture, with his wife Ruth.
